1. הסכמה לתנאים

התנאים האלה חלים על האתר, על האפליקציה Pointy למק ועל חשבון המשתמש (יחד: "השירות"), שמופעלים על ידי תומר צורף. השימוש בשירות מהווה הסכמה לתנאים ולמדיניות הפרטיות. התנאים מנוסחים בלשון רבים ופונים לכל המגדרים.

2. גיל

השירות מיועד לבני 18 ומעלה. פתיחת חשבון מותנית באישור שאתם בני 18 ומעלה.

3. מה השירות

Pointy היא אפליקציה למק שמשתמשת ב־Claude של Anthropic כדי להראות על המסך איפה ללחוץ, צעד אחרי צעד. האפליקציה והקוד שלה שייכים לנו, ומותר להשתמש בהם רק לפי התנאים האלה. החשבון באתר מאפשר כרגע הרשמה לגישה מוקדמת למסלולים.

4. מפתח API וחיובים של Anthropic

בגרסת המפתחים (Developer) אתם משתמשים במפתח API משלכם. החשבון שלכם מול Anthropic, החיובים עליו והעמידה בתנאים ובמדיניות השימוש של Anthropic הם באחריותכם. מונה העלויות באפליקציה הוא הערכה בלבד; החשבון המחייב הוא זה שב־Anthropic Console.

5. הדרכה של בינה מלאכותית עלולה לטעות

Pointy מציע איפה ללחוץ ומה לעשות, אבל ההצעות נוצרות על ידי בינה מלאכותית ועלולות להיות שגויות, חלקיות או לא מתאימות לגרסה שלכם. ההחלטה אם לבצע פעולה, והאחריות לתוצאה, הן שלכם. לפני פעולה שאי אפשר לבטל (מחיקה, תשלום, שליחה, שינוי הגדרות מערכת) בדקו שהיא נכונה, ושמרו גיבוי של מידע חשוב. Pointy לא לוחץ בשבילכם; הוא רק מראה.

6. שימוש מותר ושימוש אסור

אסור להשתמש בשירות כדי:

לצלם או לשלוח מסך של אדם אחר, או מידע של אחרים, בלי הרשאה.
לשלוח ל־Claude מידע שאסור לכם לשתף, למשל מידע סודי של מעסיק או מידע רפואי של אחרים.
לעקוף אמצעי אבטחה, רישוי או הגבלות של תוכנה אחרת.
לפתוח חשבונות מרובים, להשתמש בבוטים, או לנסות לגשת למידע של משתמשים אחרים או לשבש את השירות.
לבצע כל פעולה שמנוגדת לחוק או לתנאים של Anthropic.

7. החשבון שלכם

חשבון אחד לכל אדם ולכל כתובת אימייל.
מסרו פרטים נכונים, שמרו את הסיסמה בסוד, והודיעו לנו על שימוש לא מורשה בחשבון.
אנחנו רשאים להשעות או לסגור חשבון שמפר את התנאים, ונודיע על כך כשאפשר.
אפשר למחוק את החשבון בכל עת בדף החשבון.

8. מסלולים, מכסות ומנויים

בקרוב יהיה אפשר להשתמש ב־Pointy דרך החשבון באתר, באחד המסלולים המפורטים בדף המחירים: Free, Pro, Max או Developer. כרגע המסלולים עוד לא פתוחים, ולא נגבה תשלום.

מכסות: לכל מסלול יש מספר שאלות בחודש ותקרה יומית. "שאלה" היא בקשה אחת ל־Pointy, כולל כל הצעדים שהוא מראה עד סוף ההדרכה. במצב מהיר שאלה נספרת כ־2. שאלות שלא נוצלו לא עוברות לחודש הבא.
מחיר וחידוש: המחיר, תדירות החיוב והחידוש האוטומטי יוצגו ליד כפתור הרכישה לפני כל תשלום. המנוי מתחדש אוטומטית כל חודש עד שמבטלים, ולא נחייב בלי הסכמה מפורשת שלכם.
ביטול: אפשר לבטל בכל עת מדף החשבון, באותה קלות שבה נרשמים. הגישה נמשכת עד סוף התקופה ששולמה. ביטול עסקה והחזרים ייעשו לפי חוק הגנת הצרכן, התשמ"א-1981.
תשלום: התשלום יבוצע דרך ספק סליקה חיצוני. פרטי האשראי לא נשמרים אצלנו.
שינויים במסלולים: נודיע במייל לפחות 30 יום מראש על שינוי מחיר או הקטנת מכסה, והשינוי יחול רק מהחיוב הבא. אפשר לבטל לפני שהוא נכנס לתוקף.
שימוש הוגן: המכסות מיועדות לשימוש אישי של בעל החשבון. אסור לשתף חשבון, למכור גישה או להפעיל את השירות באופן אוטומטי. אם יש חשש לשימוש לרעה, נוכל להגביל את החשבון זמנית ולפנות אליכם.
מפתח אישי: מי שמשתמש במפתח API משלו לא כפוף למכסות. עליו חל סעיף 4.

גרסת המפתחים (Developer): רישיון אישי לשימוש ב־Pointy למק עם מפתח API משלכם, בתשלום חד־פעמי של ₪129.90, בלי חידוש ובלי חיוב נוסף מאיתנו.

"לכל החיים": הרישיון תקף כל עוד אנחנו מציעים את Pointy למק, וכולל את כל העדכונים שנפרסם לה. הוא לא כולל שאלות דרך החשבון (המסלולים בתשלום) ולא את החיובים של Anthropic.
אישי: הרישיון שייך לבעל החשבון. אסור להעביר, למכור או לשתף אותו.
ביטול והחזר: לפי חוק הגנת הצרכן, התשמ"א-1981.
הפסקת השירות: אם נפסיק להציע את Pointy למק בתוך 24 חודשים מהרכישה, נחזיר את התשלום באופן יחסי.

ביטול עסקה והחזר כספי

14 יום, החזר מלא: אפשר לבטל את הרכישה הראשונה של מנוי Pro או Max, או את רכישת רישיון Developer, תוך 14 יום מהרכישה, ולקבל החזר מלא בלי דמי ביטול. ביטול של Developer מבטל גם את הרישיון.
איך מבקשים: כותבים ל־trypointy@gmail.com או בוואטסאפ 050-8882972, עם כתובת המייל של החשבון. ההחזר יבוצע לאמצעי התשלום המקורי תוך 14 יום מקבלת הבקשה.
אחרי 14 יום: מנוי אפשר לבטל בכל רגע בדף החשבון. החיובים הבאים נעצרים, הגישה נמשכת עד סוף התקופה ששולמה, ולא מוחזר חלק יחסי מחודש שכבר התחיל.
חיוב חודשי שלא עבר: נודיע לכם במייל ובדף החשבון. המסלול נשאר פעיל עוד 3 ימים כדי שתספיקו לעדכן כרטיס, ואחר כך החשבון עובר ל־Free. עדכון כרטיס נעשה דרך הפנייה אלינו, ונשלח קישור מאובטח.
דבר בסעיף הזה לא גורע מזכויות שלכם לפי חוק הגנת הצרכן, התשמ"א-1981, ולפי התקנות שלו.

9. קניין רוחני וסימנים מסחריים

השם Pointy, הלוגו, האפליקציה, הקוד שלה ועיצוב האתר שייכים לנו. אסור להעתיק, להפיץ, לפרק או לשנות את האפליקציה, אלא במידה שהדין מתיר במפורש. Apple, Mac ו־macOS הם סימנים מסחריים של Apple Inc.; Claude ו־Anthropic של Anthropic PBC; Adobe ו־Premiere Pro של Adobe Inc. Pointy אינו קשור, ממומן או מאושר על ידי אף אחת מהחברות האלה.

10. תלונות על זכויות יוצרים

אם לדעתכם תוכן בשירות מפר זכויות שלכם, כתבו ל־trypointy@gmail.com עם פרטי היצירה, מיקום התוכן ופרטי התקשרות, ונטפל בפנייה בהקדם.

11. השירות ניתן כמות שהוא (AS IS)

השירות ניתן כמות שהוא וכפי שהוא זמין, בלי התחייבות שיהיה רציף, נקי משגיאות או מתאים למטרה מסוימת. במידה המרבית שהדין מתיר, לא נהיה אחראים לנזק עקיף או תוצאתי, לאובדן מידע או לחיובים מצד שלישי שנובעים מהשימוש בשירות. דבר בתנאים האלה לא גורע מזכויות שאי אפשר לוותר עליהן לפי דין, כולל זכויות צרכנים.

12. דין ושיפוט

על התנאים חל הדין הישראלי, וסמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים בתל אביב-יפו. אם אתם צרכנים במדינה אחרת, ייתכן שגם הגנות צרכניות מחייבות של המדינה שלכם יחולו עליכם.

13. שינויים בתנאים

נעדכן את התנאים בדף הזה. על שינוי מהותי נודיע לבעלי חשבון במייל לפני שייכנס לתוקף. המשך שימוש אחרי מועד התחולה מהווה הסכמה לתנאים המעודכנים.

Terms of Use

1. Agreement

These terms cover the website, the Pointy app for Mac and your account (together, the "Service"), operated by Tomer Zoref. Using the Service means you accept these terms and the Privacy Policy.

2. Age

The Service is for people aged 18 and over. Creating an account requires confirming that you are 18 or older.

3. What the Service is

Pointy is a Mac app that uses Anthropic's Claude to show on screen where to click, step by step. The app and its code belong to us and may be used only under these terms. The website account currently lets you sign up for early access to the plans.

4. Your API key and Anthropic charges

With the Developer license you use your own API key. Your Anthropic account, its charges and your compliance with Anthropic's terms and usage policies are your responsibility. The app's cost counter is an estimate only; your Anthropic Console shows the actual bill.

5. AI guidance can be wrong

Pointy suggests where to click and what to do, but its suggestions are generated by AI and may be wrong, incomplete or not match your version of an app. Whether to take an action, and its outcome, is your decision and your responsibility. Before anything you can't undo (deleting, paying, sending, changing system settings), check that it's right and keep a backup of important data. Pointy never clicks for you; it only points.

6. Acceptable use

You may not use the Service to:

Capture or send another person's screen or data without permission.
Send Claude information you aren't allowed to share, such as an employer's confidential data or other people's medical data.
Bypass the security, licensing or restrictions of other software.
Create multiple accounts, use bots, try to access other users' data or disrupt the Service.
Do anything unlawful or against Anthropic's terms.

7. Your account

One account per person and per email address.
Give accurate details, keep your password secret, and tell us about any unauthorized use.
We may suspend or close accounts that break these terms, with notice where possible.
You can delete your account any time from the account page.

8. Plans, quotas and subscriptions

Soon you'll be able to use Pointy through your website account, on one of the plans on the pricing page: Free, Pro, Max or Developer. These plans aren't open yet, and nothing is charged today.

Quotas: each plan has a number of questions per month and a daily cap. A "question" is one request to Pointy, including every step it shows until the guidance ends. In fast mode a question counts as 2. Unused questions don't roll over.
Price and renewal: the price, billing period and automatic renewal will be shown next to the purchase button before any payment. Subscriptions renew automatically every month until you cancel, and we never charge without your explicit consent.
Cancellation: cancel any time from your account page, as easily as you signed up. Access lasts until the end of the paid period. Cancellations and refunds follow the Israeli Consumer Protection Law, 1981.
Payment: payments are processed by an external payment provider. We never store your card details.
Plan changes: we'll email you at least 30 days before any price increase or quota reduction, and it applies only from your next billing date. You can cancel before it takes effect.
Fair use: quotas are for the account holder's personal use. Don't share accounts, resell access or automate the Service. If we suspect abuse, we may temporarily limit the account and contact you.
Your own key: if you use your own API key, quotas don't apply; section 4 does.

Developer license: a personal license to use Pointy for Mac with your own API key, for a one-time ₪129.90, with no renewal and no further charge from us.

"For life": the license is valid for as long as we offer Pointy for Mac and includes every update we release for it. It doesn't include questions through your account (the paid plans) or Anthropic's charges.
Personal: the license belongs to the account holder. Don't transfer, sell or share it.
Cancellation and refunds: under the Israeli Consumer Protection Law, 1981.
If we stop: if we stop offering Pointy for Mac within 24 months of your purchase, we'll refund you pro rata.

Cancellations and refunds

14 days, full refund: you can cancel your first Pro or Max purchase, or a Developer license, within 14 days and get a full refund with no cancellation fee. Refunding a Developer license also revokes it.
How to ask: email trypointy@gmail.com or WhatsApp 050-8882972 from your account's email address. We refund to the original payment method within 14 days of your request.
After 14 days: cancel a subscription any time on your account page. Future charges stop and you keep access until the end of the paid period; a month already started isn't refunded pro rata.
A declined monthly charge: we'll let you know by email and on your account page. Your plan stays active for 3 more days so you can update your card, then the account moves to Free. To update your card, contact us and we'll send a secure link.
Nothing in this section limits your rights under the Israeli Consumer Protection Law, 1981, and its regulations.

9. Intellectual property and trademarks

The Pointy name, logo, app, its code and the site design are ours. Don't copy, distribute, decompile or modify the app, except as the law expressly allows. Apple, Mac and macOS are trademarks of Apple Inc.; Claude and Anthropic of Anthropic PBC; Adobe and Premiere Pro of Adobe Inc. Pointy is not affiliated with, sponsored or endorsed by any of these companies.

10. Copyright complaints

If you believe content in the Service infringes your rights, email trypointy@gmail.com with the work, where the content is and your contact details, and we'll handle it promptly.

11. Provided "as is"

The Service is provided as is and as available, without any promise that it will be uninterrupted, error-free or fit for a particular purpose. To the fullest extent the law allows, we are not liable for indirect or consequential damage, lost data or third-party charges arising from using the Service. Nothing in these terms limits rights that cannot be waived by law, including consumer rights.

12. Governing law

These terms are governed by Israeli law, and the competent courts in Tel Aviv-Jaffa have exclusive jurisdiction. If you are a consumer elsewhere, mandatory consumer protections of your country may also apply.

13. Changes

We'll update these terms on this page. For material changes we'll email account holders before they take effect. Continuing to use the Service after that date means you accept the updated terms.
